IP rights and how important it is

 IP or intellectual property, is a mark of intangible creations that you or a company has made. They can be in a form of trademarks, patents, copyrights and trade secrets. IP is very important in creative industries since otherwise you will be able to monetize your creations and wont be able to do anything by law. Lets take NFT's (Non-Fungible Tokens) this technology failed catostrophically due to the fact that you were not protected by any IP law.  But what if you are making a game that you want to have open source code? Then monetize your assets but not the code, plus nobody cancelled donations to your game.


Copyright is important mainly due to the fact that you can just simply loose money if you someone just takes what you created, modified it by a bit and then also started monetizing it. And people will most properly go to the person who modified your creation since there can be things that attracts their attention a bit more.

Lets take interesting case that happened in Sweden. The Legendary Pirate-Bay. Gottfrid Svartholm and Fredrik Neij are a part of pro-culture anti-copyright organization "Piratbyran". The Pirate-Bay has gained a lot of attention since big companies who accused the Pirate-Bay in copyright infrigment. But the thing is the people who initially posted the Magnet Links for the Torrents, have bought the original product. The Pirate-Bay is just a platform for sharing since you dont delete the original product when posting it on Torrent websites, you only shared what you have and nobody made money from that. Unfortunately, the Pirate-Bay founders have been found guilty in copyright infrigment and have been sentenced to a year of jail and a fine of 3.2 million USD.

IP dont always stifle the creative industry. In my opinion, the problem arises when you just simply copy paste the products (be it 3d models, sound designs etc.) and if there are no agreements between two parties on usage of specfic IP, then we have problems. Otherwise, if we have agreements of usage of IP and if there at least some modifications done, there shouldn't be any problem in creative work.
